Terms of Service

These terms govern your use of ShowSense, operated by Dead Air Sports LLC ("we", "us"). By using the service you agree to them.

1. Access

ShowSense is currently invite-only. Access may additionally be subject to a separate confidentiality agreement, which continues to apply alongside these terms. We may suspend or withdraw access at any time.

2. Your account

You are responsible for activity under your account and for the accounts of anyone you grant a seat on your channel. Tell us promptly if you believe your account has been compromised.

3. Your content and your data

You retain ownership of everything you put into ShowSense — your show profile, transcripts, thumbnails and the metadata generated for you — and of your channel's performance data. You grant us only the permission needed to operate the service for you, as described in the Privacy Policy.

4. Generated output

ShowSense produces suggestions using AI. Output can be wrong, and you are responsible for reviewing anything before you publish it. Two specifics worth stating plainly:

Chapter timestamps are estimated from the position of text within a transcript scaled to the runtime you supply. They are not read from the video timeline. Check them before publishing.
Performance findings are statistical and depend on how much data exists. The interface shows the sample size behind each ranking; treat low-sample results as provisional.

We make no guarantee that following a suggestion will improve any metric.

5. Acceptable use

You agree not to:

use the service to generate misleading claims about content that does not deliver them;
attempt to access another customer's data;
reverse engineer the service, or use it to build a competing product;
resell or sublicense access without our written permission;
use the service in breach of YouTube's Terms of Service or any applicable law.

6. Third-party services

ShowSense depends on YouTube's APIs and other providers. Your use of YouTube data is also governed by the YouTube Terms of Service and the Google Privacy Policy. Availability and behaviour of those APIs is outside our control; features that depend on them may change or stop working if the provider changes them.

7. Availability

The service is provided as-is, without warranty. We do not guarantee uninterrupted availability, and performance data collection depends on third-party systems delivering it.

8. Liability

To the fullest extent permitted by law, our total liability arising from the service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential loss, including lost revenue or audience.

9. Termination

You may stop using the service at any time and request deletion of your data. We may terminate access for breach of these terms. Sections 3, 5, 8 and 10 survive termination.

10. Governing law

These terms are governed by the laws of the State of Ohio, United States, and disputes will be resolved in the state or federal courts located there.
